WORK PERMIT SCHEME CRITERIA
 


Work Permit Scheme Criteria :

Decisions on work permit applications are made against the following criteria:

  • Whether there is a UK-based employer;
  • Whether the individual is going to be an employee of the UK employer;
  • Whether there is a genuine vacancy for an employee in the UK;
  • Whether there are suitably qualified or experienced 'resident workers' available
  • Whether the skills, qualifications and experience needed to do the job on offer meet specific requirements;
  • Whether the person is suitably qualified or experienced to do the job on offer
  • Whether the pay and conditions of employment are equal to those normally given to a resident worker doing similar work;
  • Whether the employer is responsible for the post and is providing a service and not just personnel where the individual will be working at the client's address. A contract needs to be provided in this case;
  • Whether the employment complies with UK legislation and any requirements for registration or licensing necessary for the employment;
  • Whether the potential employee has a significant shareholding or beneficial interest in the business or connected businesses;

To qualify for a work permit the individual should have EITHER - the following qualifications:

1. a UK equivalent degree level qualification (that is recognised in the UK via NARIC); or

2. a Higher National Diploma (HND) level qualification which is relevant to the post on offer; or

3. a HND level qualification, which is not relevant to the post on offer PLUS at least one year of relevant work experience;

OR the following skills:

1. at least 3 years of experience using specialist skills acquired through doing the type of job for which the permit is sought. This should be at National / Scottish Vocational Level (N/SVQ) level 3 or above

Established UK Company

If a work permit has not been applied for in the past 5 years Work Permits (UK) will require documents which establish that the company is a UK based employer, with a trading presence in the UK and which is capable of offering a genuine vacancy. Document required to prove this include:

A copy of the UK employer's latest audited accounts with the accountant's name clearly shown, or a copy of the latest UK annual report;

If neither of these are available, any other relevant documents that clearly show the company is a UK based employer. Examples are listed below, and it is good practice to show as many as possible:

- lease of premises document
- invoices and receipts for work undertaken
- utility bills
- VAT returns
- P24N1 document form the Inland Revenue
- Proof of a company bank account
- Copies of pay slips for current UK employees
- Copy of employer's Liability Insurance certificate
- Copy of the Health & Safety certificate issued by local authority or Fire Brigade;
- Copy of P60
- Any publicity / marketing material the UK company uses
